bellcar5 It all started when the socialist, Charles Schenck, mailed out over 16,000 pamphlets to men selected to serve as a form of protest against the world war, which he strongly opposed
bellcar5 In June 1917, shortly after U.S. entry into World War I, Congress passed the Espionage Act. It prevented any attempt to cause insubordination among military personnel
bellcar5 He was arrested three days after the act was passed for violating it through his pamphlets encouraging draftees to refuse military service.
bellcar5 Schenck was convicted and thrown in jail
bellcar5 The case started in a federal district court but was appealed by Schenck, moving it up to the Supreme Court. Schenck (the appellant) felt it was against his rights of freedom of speech.

bellcar5 Schenck claimed his actions were a form of free speech and that the espionage act abridged the first amendment

bellcar5 In a 9-0 decision, the Supreme Court ruled in favor of the United States.
bellcar5 This case had a major impact on the American Judiciary system because it was the first time that the rights in the 1st amendment were limited.
bellcar5 In my opinion, I think the Supreme Court made the right decision. They made an Act and he violated it so therefore, he gets punished.
bellcar5 Supreme Court, in this case, established new standard for judging in which dangerous speech could be restricted
bellcar5 This case is still controversial today due to the topic. After this case, more and more people were charged under the Espionage Act.
