nickadams393 Hazelwood School District v. Kuhlmeier
nickadams393 The students of Hazelwood East High School create a newspaper for the school it is called Spectrum.
nickadams393 The Principle has to approve the newspaper before it is published. He did not agree with and or like two of the articles in the paper so he took them out entirely without telling the students.
nickadams393 Cathy Kuhlmeier did not like this and said it broke the first amendment which is fredom of speech
nickadams393 So they went to court
nickadams393 Hazelwood School Distric said that the school had control over what was posted in the schools newspaper and that it did not break their freedom of speech.
nickadams393 The Supreme Court decision was 5-3 in favor of the Hazelwood school District which reversed the decision from the lower court.
nickadams393 Majority Opinion included Justice White joined by Chief Justice Rehnquist and Justices O'Connor and Scalia
nickadams393 Dissenting Opinions were Justice Brennan joined by Justices Marshall and Blackmun
nickadams393 The significance of this case is that schools do have the right to deem what is inappropriate or not right to be in schools paper and it not break freedom of speech.
nickadams393 I feel as if he Supreme Court made the right decision because schools should be able to limit what is said and published in the school paper.
